STATE FEE INCREASE
Acts 113 and 126 of 2014, included in the recently passed State budget, increases the Judicial Computer System/Access to Justice/Criminal Justice Enhancement Account (JCS/ATJ/CJEA) fee from $23.50 to $35.50. This increase in the State's fee will take effect on August 1, 2014. The JCS/ATJ/CJEA fee is a State imposed fee on the Initial/First filing of a Petition in the Register of Wills/Clerk of the Orphans' Court.
The Register of Wills is an elected official who serves as Register of Wills and Clerk of the Orphans' Court. The Register of Wills has jurisdiction of the probate of wills and the grant of letters to a personal representative.
Letters Testamentary (with a will) or Letters of Administration (no will) are granted to properly qualified individuals who meet the requirements of the Probate, Estates and Fiduciaries Code. When disputes arise at the time of probate, the Register, as a quasi-judicial officer, is empowered to hold a hearing, take testimony, review evidence and render a decision on the issue presented.
The Register is also an agent for the collection of inheritance taxes for the Commonwealth of Pennsylvania, Department of Revenue. In the calendar year 2013, the amount of inheritance tax collected by the Register of Wills was $25,213,578.15. This amount represents the largest annual inheritance tax collection in the history of the Register of Wills office which was established in 1749.
Since taking office in 2000 the current Register of Wills remitted in excess of $270 million to the PA. Dept. of Revenue, Inheritance Tax Div. from York County Estates.
